Excise Duty Case Studies

The Khan Partnership is widely recognised by its peers in the UK as a leading law firm representing clients in cases regarding excise duty.

Acting for a large London based “craft brewery” in respect of  a nationally publicised dawn raid by HMRC and seizure of a substantial quantity of alcohol products due to the alleged non-payment of excise duty and VAT.  We represented our client at the police station interview, attended at the seizure and prevented HMRC from seizing some of the stock. We instituted condemnation proceedings in the Magistrates Court against HMRC challenging the legality of the seizure and the circumstances in which it was conducted.

Instructed by a Scottish distillery in relation to an excise duty dispute with HMRC concerning whiskey under bond.  We challenged the legality of HMRC’s proposed duty assessments and the matter was referred to HMRC’s Excise Duty Policy Team.  Our arguments were eventually accepted by HMRC and a duty assessment was not issued.

Advising a multi-national cross channel ferry operator in relation to a complex duty investigation into alleged under declaration of £33million of excise duty on alcohol and tobacco sales on “duty free” sales over a decade.

Acting for a business subject to a dawn raid over alleged involvement in excise duty evasion of £14million of tax and associated allegations of money laundering.
